Frequently Asked Questions

Below are the answers to some of the questions we are most frequently asked. Please do not hesitate to contact us if you have any questions that are not covered below.

How would you select the most suitable patent agency for our company?
We would go through the following steps:

Investigation
We would first assess your patent portfolio by asking a number of questions regarding, for example:
  • your annual number of patent applications
  • the main IPC classes of your patent applications
  • your most important competitors
  • the preferred number of patent agencies to be selected
  • the preferred size of the patent agency.

Longlist
We would then incorporate your company-specific criteria into our proprietary database. This would result in a longlist of agencies to be considered.

Request for Information
Next, we would send each agency on the longlist a Request for Information that asks very precise questions regarding, for example, their expertise, size, and client portfolio.

Shortlist
The Request for Information would result in a shortlist of agencies that meet your criteria.

Personal or telephone interviews with IP agencies
We would then organize interviews with the shortlisted agencies, at their own offices or by telephone. These structured interviews would allow us to verify whether the proposed patent attorneys meet all your criteria.

Extended test phase (optional)
We could also organize an extended test phase of the shortlisted agencies. For example, we could organize telephone conferences between the in-house and the outside attorneys to discuss complex office actions.

Negotiation
At this stage, we would be able to start the negotiations. The remaining companies on the shortlist would be sent a Request for Quotation and may be invited to participate in further negotiations.

You select
After the negotiation process, you would determine whether the most economical agency is also the agency that best suits your company.

How would you find patent agencies that understand our products?
When drawing up the longlist, we would apply various methods to find the right patent agencies. For instance, we would:
  • include patent agencies that have filed many patent applications in your main IPC classes
  • exclude patent agencies that are working for your most important competitors
  • apply web robots to find very specific information on the Internet.

When drawing up the shortlist, we would include the agency-specific information that had been revealed by the Requests for Information.

How would you find patent attorneys who understand our products?
We would also apply various methods to find the right patent attorneys, for example:
  • we would analyze the profiles of all proposed patent attorneys regarding, for instance, their educational background, major professional achievements, background in patent law, and experiences in industry
  • during the interviews we would assess whether the proposed attorneys speak your company language.


How would you calculate the cost savings?
We would calculate the cost savings on the basis of the difference between the attorney fees before and after our mediation. A typical sheet to calculate the savings would include:
  • your requested service items (e.g., filing applications, filing requests for examination, reporting and responding to office actions, patent registration, translation)
  • your estimated workload per service item
  • the actual attorney fees
  • the new attorney fees.
